Two legal actions contest Trump’s move to terminate TPS for Venezuelans

Two lawsuits have been filed challenging the Trump administration’s decision to end Temporary Protected Status (TPS) for hundreds of thousands of Venezuelans living in the United States. Immigrant advocacy groups, including CASA and Make the Road New York, argue that the decision is unconstitutional and racially discriminatory, putting Venezuelans at risk of deportation to a country experiencing a humanitarian crisis. The lawsuits were filed in Maryland and California against the Department of Homeland Security. One lawsuit was filed by a Venezuelan single mother who fears for her family’s future. The Department of Homeland Security has not responded to requests for comment on the lawsuits.

President Joe Biden had extended temporary protection for Venezuelans until 2026, but Trump’s order would end TPS for Venezuelans in 2023 and 2021. TPS is granted to immigrants who cannot return to their countries due to natural disasters or political unrest, but does not provide a path to citizenship. Advocates argue that the Trump administration’s decision was racially motivated and discriminatory, violating the Equal Protection Clause of the Fifth Amendment. The lawsuits aim to protect the rights of Venezuelans and immigrant families facing deportation. The National TPS Alliance has also filed a separate lawsuit in San Francisco, citing racially motivated comments made by Trump administration officials. Immigrant rights groups are pushing back against the administration’s attempts to deport and dismantle immigrant families, emphasizing the need to protect all immigrant communities.
