NCAA Sued by Wisconsin Football Player Nyzier Fourqurean Over Eligibility

University of Wisconsin senior cornerback Nyzier Fourqurean has sued the NCAA in an effort to stop the association from enforcing its five-year rule for D-I football ahead of the 2025 NFL Draft entry deadline next week. Fourqurean argues that the NCAA’s enforcement of eligibility rules violates federal antitrust law as he seeks to play for the Badgers this fall and benefit from NIL deals and revenue sharing opportunities.

The case is similar to Vanderbilt quarterback Diego Pavia’s litigation against the NCAA last November, where a preliminary injunction was granted in Pavia’s favor, allowing him an additional year of eligibility. Fourqurean is seeking a temporary restraining order to know his eligibility status by February 7, the NFL opt-out deadline for the 2025 draft.

Concerns have been raised about the NCAA’s eligibility rules in recent cases, with courts increasingly recognizing college athletics as a labor market where athletes can benefit economically from their skills and NIL opportunities. The NCAA emphasizes the importance of maintaining rules that balance academic and personal objectives with professional endeavors.

As the legal battle unfolds, the NCAA plans to oppose the motion for a temporary restraining order and defend its rules. With ongoing changes in NIL regulations and a patchwork of state laws, the NCAA believes partnership with Congress is crucial to provide stability for college athletes in the future. The outcome of the Fourqurean case could have far-reaching implications for the landscape of collegiate sports.
