Suspect in fatal crash involving Johnny Gaudreau alleges victims were also impaired during bicycle accident


Sean Higgins, the driver accused of killing NHL star Johnny Gaudreau and his brother Matthew, claimed in court papers that he is being unfairly prosecuted and that the victims of the deadly crash were more impaired than he was. The lawyers for Higgins requested more information on testing protocols for blood-alcohol concentrations of both the defendant and the victims. The incident occurred on August 29, 2021, in Oldsman Township, outside Philadelphia and Wilmington, where the Gaudreau brothers were fatally struck while bicycling.

The State alleges that Higgins had a blood-alcohol concentration of .087, while the victims, John and Matthew Gaudreau, had concentrations of .129 and .134 respectively. However, a BAC of .08 is considered impaired in New Jersey, with the potential for conviction even below that threshold. The defense argued that Higgins is being overcharged with reckless vehicular homicide and aggravated manslaughter, potentially facing 35 years in prison.

Comparisons were made to other cases in Salem County, citing sentences of seven years for individuals with higher BAC levels. The defense claimed that the plea offer of 35 years is out of line with other cases in the area. Salem County Prosecutor’s Office has not yet responded to these claims. Sean Higgins’ case continues to unfold as he fights the charges brought against him in connection to the tragic incident involving Johnny and Matthew Gaudreau.
