MADISON, Wis. — The Trump administration reaffirmed its stance on Monday against dismissing charges against Milwaukee County Circuit Judge Hannah Dugan, who is accused of assisting a man evading U.S. immigration authorities. Federal attorneys asserted in court that dismissing the charges would set a troubling precedent, potentially allowing judges to evade legal accountability.

Dugan, who faces trial on July 21 for misdemeanor and felony charges, allegedly facilitated Eduardo Flores-Ruiz’s escape from the courthouse on April 18. Prosecutors assert that Dugan escorted Flores-Ruiz, who was in the U.S. illegally, and his lawyer out through a back door after being informed that U.S. Immigration and Customs Enforcement agents were present to arrest him.

Her legal team has filed a motion to have the charges dismissed, arguing that Dugan acted within her judicial capacity, which should grant her immunity. They also claim that the federal government’s actions intruded upon Wisconsin’s state sovereignty.

The Justice Department countered, warning that granting immunity would imply judges could obstruct valid law enforcement operations. Judge Dugan’s actions have drawn criticism; her arrest has sparked claims that the Trump administration is making an example of her to deter judicial dissent against its stringent immigration policies.

Dugan’s defense fund has seen considerable support, raising over $137,000 from thousands of donors, signaling public backing for an independent judiciary. As the case unfolds, Dugan maintains her innocence and awaits her trial, while broader debates on the implications of her case continue to resonate in the political landscape.

This situation mirrors a similar case during the previous Trump administration involving a Massachusetts judge charged with aiding an undocumented immigrant, which ultimately was dismissed.
