Wisconsin Supreme Court Suspends Dane County Judge for Unprofessional Conduct
MADISON, Wis. (AP) — The Wisconsin Supreme Court has suspended Dane County Judge Ellen Berz for a week following her impulsive actions in court, marking the second suspension of a Wisconsin judge in less than two months. The court’s decision comes after Berz’s attempts to personally arrest a hospitalized defendant and her sarcastic remarks to another defendant.
The suspension, effective June 26, aligns with the recommendation from a judicial conduct review panel, emphasizing the need for judges to exhibit patience, impartiality, and professionalism. In their order, the justices underscored the importance of maintaining public confidence in the judiciary.
Berz, who acknowledged her actions and accepted responsibility, faced scrutiny for her behavior in a December 2021 case where a defendant failed to appear in court due to hospitalization. After discovering the defendant was in an emergency room, Berz attempted to leave the courthouse to fetch him herself, reportedly stating that she would draw media attention if anything happened to her. Ultimately, she was persuaded to return to court by the defendant’s attorney.
Additionally, the Wisconsin Judicial Commission’s misconduct complaint highlighted Berz’s failure to treat individuals with professionalism and impartiality. In another case, she reportedly told a defendant seeking a trial delay that he was "playing games," further showcasing her lack of restraint.
This incident follows the suspension of Milwaukee County Circuit Judge Hannah Dugan, who is currently facing federal charges related to obstructing immigration enforcement. Dugan has pleaded not guilty and is set to stand trial in July.
As the judiciary grapples with maintaining standards of conduct, the Supreme Court’s actions reflect a commitment to upholding professionalism among judges in Wisconsin.
