AI in Wisconsin Courtrooms: A Controversial Proposal to Replace Human Interpreters
A proposal by Wisconsin lawmakers to allow the use of artificial intelligence (AI) in courtrooms for non-English-speaking defendants has sparked a heated debate. Currently, state law mandates the use of certified human interpreters, who are crucial for ensuring defendants understand courtroom proceedings. However, a significant shortage of interpreters has led to delays and increased costs for counties.
Representative Dave Maxey, who introduced the bill, argues that AI translation could not only fill the interpreter gap but also save the state and local governments substantial funds, estimated in the hundreds of thousands of dollars annually. "If we can use AI to cut some of those costs, while still providing adequate service, it’s a win for counties facing budget constraints," he stated.
Despite these potential benefits, critics express concern over the reliability of AI in legal contexts. Amanda Merkwae, advocacy director for the ACLU of Wisconsin, highlights that the technology may not adequately meet the nuanced needs of courtroom interpretation, especially when liberty interests are at stake. "The stakes are too high to risk errors in translation," she remarked, emphasizing the need for human interpreters bound by ethical standards of accountability.
The bill, which would permit—but not require—the use of AI interpreters, has not yet garnered widespread support. As state officials maintain a cautious stance, urging a focus on accuracy and effective communication, many believe that alternative solutions—such as increasing funding or expanding access to certified interpreters—should be explored first.
With a diverse population of over 178,000 Wisconsin residents speaking limited English, the demand for interpreters remains high. As lawmakers consider this innovative shift, the balance between technological advancement and fundamental rights in the justice system hangs in the balance.
