Fourqurean from Wisconsin files injunction claiming Division II years should not affect eligibility

Wisconsin cornerback Nyzier Fourqurean has filed for an injunction to challenge the NCAA’s decision to count his two seasons at Division II program Grand Valley State against his college eligibility. In a brief filed in court, Fourqurean argued that he should be granted an additional year of eligibility after completing his senior season at Wisconsin. This comes after a federal judge granted a preliminary injunction allowing another player in a similar situation to gain another year of eligibility.

Fourqurean enrolled at Grand Valley State in 2020 but didn’t play due to the pandemic, and then played in 2021 and 2022 before transferring to Wisconsin in 2023. If he isn’t granted additional eligibility, he would need to declare for the NFL draft by February 7 to continue his football career. The NCAA’s decision not to grant Fourqurean a waiver is being challenged on the grounds of violating antitrust laws, limiting his economic opportunities for name, image, and likeness benefits, and interfering with his contract with Wisconsin.

Despite the NCAA issuing a waiver for athletes who played at non-NCAA schools for over a year, Fourqurean’s case remains unresolved. His complaint highlights the discrepancy between Division I and Division II players in terms of eligibility and NIL opportunities.
