Judge in Dane County invalidates over 60 provisions of Act 10


In a recent ruling, Dane County Circuit Court Judge Jacob Frost struck down more than 60 sections of Act 10 as unconstitutional, following up on his previous opinion allowing a lawsuit challenging former Governor Scott Walker’s restrictions on public employee union power. Frost’s ruling focused on how Act 10 treated municipal police officers differently from other public safety officers, ultimately deeming certain sections of the law unconstitutional.

The ruling has been met with mixed reactions, with supporters of Act 10 pointing to the billions of dollars it has saved Wisconsin taxpayers, while critics, including unions, welcome the restoration of bargaining rights for public sector workers. The case is expected to head for an appeal, with Republican Assembly Speaker Robin Vos promising to present arguments in defense of Act 10.

The controversial 2011 law has withstood previous legal challenges, but with the recent ruling, tensions are likely to escalate as the case could reach the currently liberal-leaning Wisconsin Supreme Court. However, a hotly contested election in April to fill a vacant seat on the bench may sway the court’s ideological balance, potentially impacting the outcome of cases related to union rights and other contentious issues.

Despite potential conflicts of interest, Justices Brian Hagedorn and Janet Protasiewicz have not committed to recusing themselves in the event that the Act 10 case reaches the state Supreme Court. As the legal battle continues, the future of public sector labor relations in Wisconsin remains uncertain.
