Wisconsin Supreme Court hears case challenging swing state’s elections administrator

The Wisconsin Supreme Court is set to hear arguments on Monday that could determine the fate of Wisconsin Elections Commission Administrator Meagan Wolfe, who has been the target of baseless Republican election conspiracy theories. Last year, Republicans in the state Senate attempted to fire Wolfe, prompting the commission to file a lawsuit to keep her in her position.

The commission is urging the state Supreme Court to uphold a lower court ruling in Wolfe’s favor so she can remain in her role without facing a confirmation vote by the Senate. Conversely, Republican lawmakers argue that the commission must appoint a new commissioner for the Senate to vote on confirmation, stating that Wolfe cannot stay in her position as a holdover.

Wolfe, appointed in 2018 and confirmed by the GOP-controlled Senate in 2019, has faced threats and conspiracy theories related to the 2020 presidential election won by President Joe Biden. Despite multiple recounts and audits confirming Biden’s win in Wisconsin, Wolfe has been accused of being part of an election rigging plot.

The case will be heard by the state Supreme Court, which will issue a decision in the coming weeks or months. Wolfe, who remains committed to seeing through the current election certification process, may potentially be allowed to stay in her position as the administrator of the Elections Commission. The state Senate, responsible for voting on appointees like Wolfe, will have a narrower Republican majority following recent elections.
