Claim of U.S. military negligence made by 100 survivors and families of Lewiston mass shooting victims

Lawyers representing survivors and families of victims of a mass shooting in Lewiston, Maine, by Army reservist Robert Card are pursuing negligence claims against the federal government. The claimants are serving legal notices to sue the Defense Department, the Army, and Keller Army Community Hospital for failing to respond to warning signs and threats made by Card before he killed 18 people in October. The case is not a class-action lawsuit, with four law firms representing 100 individuals seeking justice for the worst mass shooting in Maine history.

Reports have highlighted missteps by the military, law enforcement, and hospital staff in responding to warning signs from Card, including his hospitalization for psychotic symptoms and homicidal ideations. The reports also indicate that the military failed to properly follow procedures after previous incidents involving Card, despite recommendations from mental health providers and his unit failed to share information about past threats he made with local law enforcement. Additionally, medical staff at Keller Army Community Hospital failed to file necessary reports to alert authorities of Card’s potential danger.

While Card’s motive for the shooting remains unclear, his family has mentioned his paranoia and hearing voices as potential factors. Despite various warning signs, opportunities to prevent the shooting were missed, according to Cynthia Young, a relative of victims. The federal government has six months to investigate the claims before potential lawsuits proceed in federal court. The case highlights the need for accountability and justice for the families and victims of the tragic event.
